ROAD CLOSURE NOTICE

On March 2, 2020 Municipal Council will be considering a recommendation to permanently close the portion of Erie Shore Drive between Erieau Road and 18416 Erie Shore Drive. A map and description of the area affected by this road closing is included below.

This closure is proposed based on engineering advice recently received by the Municipality which indicates a substantial risk that the dike upon which Erie Shore Drive is located could fail. As a result a state of emergency has been declared.  The nature of the engineering work requires a permanent road closure.

Municipal administration is recommending that the road be closed permanently on March 9, 2020, and the road may be closed sooner if conditions on the dike deteriorate further.

Notice of Proposed Road Closing

WHEREAS Council has received engineering information indicating that there is an elevated possibility of failure of a portion of that public highway known as Erie Shore Drive;

WHEREAS a failure of that part of the public highway could cause serious risk to life and property;

WHEREAS, in response, on February 28, 2020, the Head of Municipal Council has declared an Emergency pursuant to the Emergency Management and Civil Protection Act in respect of the Emergency Area;

NOTICE IS HEREBY GIVEN THAT at a meeting of the Council of the Municipality of Chatham-Kent on March 2, 2020 at 6:00 p.m. in the Council Chambers, Civic Centre, 315 King Street West, Chatham, Council will consider, and if approved, may pass a by-law to:

  • Effective March 9, 2020, permanently stop up and close that part of the road allowance being part of Erie Shore Drive, described as Part of 00938-1125, legally described as LAKESHORE RD., PLAN 398, 421 & 426, ROADWAY 30 FT WIDE, PLAN 421 BEAVER CREEK DREDGE CUT, PLAN 421, LYING BETWEEN N LIMIT OF LAKE SHORE DRAIN AND LAKE ERIE, TRAVELLED RD THROUGH PT LOT 3, PLAN 302 AS IN HA17005, LYING BETWEEN S LIMIT OF CLARKE SIDEROAD & W LIMIT OF THE BEAVER CREEK DREDGE CUT, PLAN 421, PT LOT 466, PLAN 421 DESIGNATED AS PT 1, 24R4927, PT LOT 407, PLAN 421 DESIGNATED AS PT 1, 24R5060 HARWICH; all of PIN 00938-1088, legally described as LAKE SHORE DRAIN, PLAN 421, LYING BETWEEN W LIMIT OF LT 439 & E LIMIT OF LT 407, PLAN 421 HARWICH; and part of PIN 00939-1089, legally described as LAKE SHORE DRAIN, PLAN 421, LYING BETWEEN W LIMIT OF LT 446 & E LIMIT OF ROADWAY 30 FT WIDE, PLAN 421 HARWICH (hereinafter referred to as the “Road Allowance”). The Road Allowance is shown on the map below, measuring approximately 2500 metres.
  • Effective March 9, 2020, permanently stop up and close the Road Allowance such that it shall not be passable by the public.
  • Effective March 9, 2020, permanently stop up and close the Road Allowance such that Municipal services shall not be provided to properties abutting the Road Allowance.
  • Effective March 9, 2020, permanently stop up and close the Road Allowance such that the Road Allowance shall not be passable by emergency vehicles and emergency services shall accordingly not be available to properties abutting the Road Allowance.
