Heritage Register

Section 27 of the Ontario Heritage Act (OHA) requires the clerk of every local municipality to keep a current, publicly accessible Municipal Register (Register) of properties of cultural heritage value or interest situated in the municipality. Prior to 2005, this Register would have included only individual properties formally designated under Part IV and districts designated under Part V of the OHA. Recent changes to the OHA and the Provincial Policy Statement (issued under the Planning Act) have had the effect of conferring broader authority to Council. This allows municipalities to add properties to the Register that have not been designated but which Council believes to be of cultural heritage value or interest. These properties are referred to as being “listed”.

Listing allows these properties to be identified as having heritage significance and requires that an owner who intends to remove or demolish any buildings or structures on the property give Council 60 days notice of their intention in writing. However, a property listed on the Register does not:

  • Include additional obligations for a property owner before proceeding with renovations, additions or the type of building materials used.
  • Involve any kind of Heritage Permit process through Heritage Chatham-Kent or Council.
  • Have any restrictions or covenants registered on title.
  • “Designate” the property under OHA.

This 60 day period is meant to provide municipalities with sufficient time to evaluate whether the property merits some form of protection such as designation under the OHA. If so, a separate formal notification and appeal process is followed. If no action is taken by Council within this 60 day period, Building Services will proceed with issuing a demolition permit.
