Open Burning in Chatham-Kent
Urban Area
In accordance with the Fire Prevention and Protection Act, O. REG. 213/07.c.4, the Ontario Fire Code Division B, Sentence 2.6.3.4.(1) of R.S.O. 1997 - Open-Air Burning is not permitted unless such burning consists of a small, confined fire supervised at all times, and used to cook food on a grill or barbecue. Once cooking is completed the fire must be extinguished. Most chimeneas, fire bowls, fire pits etc, do not comply with the above Fire Code Article and are only allowed with a grill for cooking purposes.
Part V11, Subsection 28(1), 28(1)(c), 28(3), 28 (3)(b), 28(4) of the Fire Prevention and Protection Act read as follows:

Every person is guilty of an offence if he or she, |

28. (1)(c) |
Contravenes any provisions of this Act or the regulations; or |

28. (3) |
An individual convicted of an offence under subsection (1) is liable to, |

(3) (b) |
In the case of an offence for contravention of the fire code, a fine of not more than $50,000 or imprisonment for a term of not more than one year, or both. |

28. (4) |
A corporation convicted of an offence under subsection (1) is liable to a fine of not more than $100,000. |
Rural Area
In accordance with the Fire Prevention and Protection Act, O. REG. 213/07.c.4, the Ontario Fire Code Division B, Sentence 2.6.3.4.(1) of R.S.O. 1997 - Open-Air Burning is not permitted unless approved by the Station Chief of your community fire station.
